World-Wide Limited Warranty Statement and Limitation of Liability

Save Energy Lighting Ltd. (Save Energy) warrants that, LED luminaire products furnished by Save Energy, except where otherwise stated, with manufacturing date code after October 2015 will continue delivering an adequate performance defined as Lumen Maintenance 70% or better, from the date of manufacture for the following time periods: Indoor luminaires with 10 year warranty indicated in the cut sheet, and installed in air-conditioned commercial spaces with max. ambient temperature 350C/95F with operating cycles not exceeding 16 hours per day, 5840 hours per year: Ten (10) Year Limited Warranty. All other products: Five (5) Year Limited Warranty

All warranty is conditional upon providing that the installation must be completed by a professional electrician with a proper and currently valid Master Electrician License.    To obtain Ten (10) Year Warranty and Six (6) year warranty, the installation must be completed by a professional electrician with a proper and currently valid Master Electrician License.   In addition, the installation must be registered with Save Energy by providing the following information on the End-user’s letter-head, by regular mail, email or fax:

  1. Date of installation
  2. End-user name, address, phone and contact name and email of Facility Manager and Maintenance Manager
  3. Name, address, phone number and contact name and email of person(s) that installed the product. Include copy of their Master Electrician License
  4. Include copy of Electrical Safety Inspection and the original Invoice for the registered materials

The warranty and remedies set forth herein are conditional upon proper transportation, storage and installation in conformance with current editions of National and local codes, Underwriters’ Laboratories Inc., Canadian Standards Association standards for safety and any Installation Instructions or recommendations of Save Energy.   Any unauthorized modification or mechanical or electrical attachment of any accessories that are not approved, will void the warranty.   The conditions of tests concerning any luminaire which is claimed to have not performed satisfactorily under this warranty shall be mutually agreed upon in writing and Save Energy shall be notified of, and may be represented at all tests that may be made on the subject luminaire.

    EXCLUSIONS

This limited warranty excludes field labour and service charges related to the repair or replacement of the Product.   Third party accessories field repair labour is always excluded.    Other Warranty exclusions are: negligence; abuse; misuse; mishandling; improper installation, storage or maintenance; damage due to fire or acts of God; vandalism; civil disturbances; voltage fluctuation, power surges; improper power supply, lost neutral connection, transient voltages; connection to unapproved third party accessories or their failure; electrical current fluctuations; Ripple Current control systems that are beyond the specified limits of the products and those defined by relevant supply standards (i.e. EN 50160); corrosive environment installations; alteration; accident; products that have had the serial number altered, defaced or rendered illegible; failure to follow installation, operating, maintenance or environmental instructions prescribed by Seller or applicable electrical codes; or service of the Product performed by someone other than Seller or its authorized service provider.   This Warranty is void if all equipment costs and all applicable taxes, duties, delivery charges, etc. are not paid for in full by Purchaser, for any reason, or when Purchaser’s account is not in a good standing. Warranty is void when the luminaire is removed from the original site.

If any luminaire fails to meet the above warranty, and if the Purchaser or the End-user (Customer) notifies Save Energy in writing within ten (10) days of discovery of the defect, and makes the luminaire available, Save Energy shall thereupon correct such defect, at Save Energy’s sole option, by either:   (A) replacing the defective luminaire (F.O.B. Save Energy Lighting plant, office or other point of shipment) with an identical or similar product or   (B) repairing the defective luminaire if possible.

No repair or other labor charges or any other costs will be paid for unless explicitly authorized in writing by Save Energy.

In all instances the Customer shall provide written notification of a claimed defect to Save Energy and be responsible for all packaging, shipping and handling costs.   Save Energy will issue proper R.M.A. number that begins with W.   Once the Customer receives proper R.M.A. number, the Customer shall return the defective luminaire to Save Energy within 30 days of R.M.A. date.    Luminaires must be returned in proper packaging as not to get damaged in transport.   No shipping damage will be repaired under warranty

The foregoing shall constitute the sole compensation to the Purchaser or the End-user and the sole liability of Save Energy with regard to warranty.   Save Energy makes no other warranty, statutory or otherwise, and none is implied.   In particular, without limiting to foregoing, no warrant of saleability or fitness for a particular purpose is made or implied.   Save Energy’s liability on any claim of any kind, including negligence for any damage arising out of, connected with, or resulting from this warrant, or from the supply or failure to supply a luminaire, or from the design, manufacture, sale, delivery, resale, installation, inspection, repair, operation or use of a luminaire furnished by Save Energy, shall in no case exceed the purchase price allocated to the luminaire or luminaires which give rise to the claim.   Save Energy reserves it’s right to change this Warranty at any time and without any notice to anyone.
